Terms and Conditions for Fractune

1. Scope of These Terms and Licence
These Terms of Use ("Terms" or "EULA") apply to all use of the Fractune app and the website fractune.dk, including the public sites map at sites.fractune.dk, the Architectural Fluency analysis pipeline, and any digital content or research data provided through the service (the "Services"). By downloading, installing, accessing or using Fractune, you accept these Terms.
For apps obtained through the Apple App Store, you acknowledge that this EULA is concluded between you and Fractune only, and not with Apple. Fractune, not Apple, is solely responsible for the Fractune app and its content.
The Fractune app and all digital content are licensed, not sold, to you. You obtain a limited right to use Fractune as described below; you do not obtain ownership of the app, the analysis algorithms, or the underlying public dataset.
If you obtained Fractune through the Apple App Store, these Terms supplement Apple's Media Services Terms and Usage Rules. Where mandatory App Store terms conflict with these Terms, Apple's terms prevail.

2. The Service
- Architectural Fluency analysis: Fractune calculates a composite Architectural Fluency value F (0–1) plus four sub-scores (fractal complexity, rhythm, colour, structure) and supporting metrics (D, Λ, Hθ, β, Rw, B, Σ_h, V, κ, Δ_L) from photographs you take of building facades. All image analysis runs locally on your iPhone.
- Public sites map: Anonymised readings you choose to contribute are published at sites.fractune.dk for browsing, filtering, and academic citation.
- Research dataset: The aggregated readings are made available under the separate Dataset Licence for academic, educational, and journalistic use.
- Free of charge: Fractune is currently provided free of charge. We may introduce subscription features in the future; if we do, this section will be amended and you will be notified before any charge takes effect.
3. User Accounts and Eligibility
Fractune does not require an account. The app generates a random contributor ID locally on your device for the purpose of attributing readings to a single source (anonymously) and so you can request erasure later. There is no minimum age restriction; we recommend that users under the age of 13 obtain parental or guardian consent before contributing readings.

4. Licence and Use of App and Content
All intellectual property rights in the Fractune app, the analysis algorithms, the F formula, the website, the science and research content, and all other materials belong to Fractune / Anders Barslund or our licensors. Subject to your continuous compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to:
- download and use the Fractune app on Apple-branded devices that you own or control; and
- access and use the public sites map and the website's editorial content (Science, Architectural Fluency, Research) for personal and educational reference.
This licence is for personal, non-commercial use unless otherwise stated. Use of the public dataset is governed by the separate Dataset Licence.
5. Restrictions
Except where permitted under mandatory law, you may not:
- copy, translate, modify, reverse-engineer, decompile, disassemble or attempt to derive the source code of Fractune;
- create derivative works based on the app, the F formula, or the analysis algorithms;
- circumvent security or technical protection measures, including the App Attest verification used to authenticate dataset submissions;
- make the app available over a network for simultaneous use on multiple devices;
- rent, lease, lend, sell, sublicense, distribute or transfer the app on a standalone basis or as part of a collection;
- submit false, fabricated, or deliberately manipulated readings to the public dataset;
- extract, scrape, bulk-download, or stockpile data from the public dataset for the purpose of building competing products or services;
- use Fractune readings, the F formula, or any output of the analysis pipeline to train, refine, or generate artificial intelligence (AI) models or competing services.
When using Fractune, you must also comply with any applicable third-party terms of agreement, including wireless data service agreements and platform-specific policies for services integrated into the app (Apple, MapKit JS).
6. Contributions to the Public Dataset
By contributing a reading with the relevant consent toggles enabled, you agree that the anonymised reading metrics, including F, D, the four dimension sub-scores, supporting raw metrics, optional location, optional building metadata, and optionally a face-redacted thumbnail, will be published as part of the public Fractune dataset and made available at sites.fractune.dk.
Reading metrics are factual measurements derived from your own photographs and as such are not subject to copyright. By contributing, you grant Fractune a perpetual, worldwide, royalty-free, non-exclusive licence to use, display, distribute, and sublicense your contributions as part of the public dataset under the Dataset Licence.
You may request erasure of all readings tied to your contributor ID at any time. We process erasure requests within 30 days.
7. Disclaimer (No Warranty)
Fractune and all Services, including the F value, the four dimension sub-scores, the public dataset, and any editorial content, are provided "as is" and "as available", without warranties of any kind, express or implied.
Fractune disclaims all warranties regarding merchantability, fitness for a particular purpose, non-infringement, accuracy, quiet enjoyment, or availability. F is a calibrated empirical measure, not a final judgement on a building, and should not be used as the sole basis for professional, scientific, or regulatory decisions. You assume all risk associated with the use of Fractune.
If you obtained Fractune via the Apple App Store and the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) paid for the app. To the maximum extent permitted by law, Apple has no further warranty obligations with respect to Fractune, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty will be Fractune's sole responsibility.
8. Limitation of Liability
To the maximum extent permitted by law, Fractune and Colours by Barslund are not liable for any indirect, incidental, special or consequential damages, including loss of profits, data, business opportunities or goodwill, arising out of or in connection with your use of Fractune.
Where liability cannot be excluded, it is limited to the amount you have paid for access to the Services during the 12 months preceding the claim. As Fractune is currently provided free of charge, this amount is zero unless and until paid features are introduced. These limitations do not affect rights that cannot be waived under Danish consumer law.
Fractune, not Apple, is responsible for addressing any claims from you or any third party relating to the app or your possession and/or use of the app, including but not limited to product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Fractune, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.
9. External Services and Technical Data
Fractune may enable access to external services or websites (e.g. links to academic references). Use of such services is at your sole risk. Fractune is not responsible for third-party content, availability or security.
Fractune may collect non-personal technical information (such as device model, OS version and crash logs) to provide updates, security, support and improvements. No personally identifiable data is collected without your consent. For more details, see our Privacy Policy.
Fractune is solely responsible for providing maintenance and support for the Fractune app. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.
By using Fractune, you represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not listed on any U.S. Government list of prohibited or restricted parties.
10. Termination
This EULA remains in effect until terminated. Your rights terminate automatically without notice if you:
- breach these Terms or the Dataset Licence;
- submit fabricated or deliberately manipulated readings to the public dataset;
- attempt to reverse-engineer, scrape, or stockpile Fractune's data; or
- misuse the app to identify, de-anonymise, or contact other contributors.
Upon termination, you must stop using Fractune and delete any local copies of the app and its data. Fractune may suspend or restrict your access, including blocking your contributor ID and removing your contributions from the dataset, to protect our services, users or licensors.
11. Disputes and Governing Law
These Terms are governed by Danish law. Disputes can be brought before the Court in Lyngby or the court where you reside, to the extent permitted by applicable consumer law.

12. Dataset Licence (Annex)
Use of the Fractune public dataset, both browsing it via sites.fractune.dk and accessing the underlying data, is further governed by our Dataset Licence, which forms an integral part of these Terms. The Dataset Licence specifies permitted academic and journalistic uses, restrictions on redistribution, scraping, and AI training.
In case of conflict between these Terms and the Dataset Licence, these Terms prevail.
You and Fractune acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.
